Trina Solar, a prominent solar panel manufacturer, has filed a formal complaint with the U.S. International Trade Commission (ITC) against Runergy and Adani Green Energy. The complaint seeks to halt the importation and sale of products that allegedly infringe on two of Trina’s U.S. patents related to TOPCon solar cell technology. Trina is calling for an investigation under Section 337 of the Tariff Act of 1930, which could lead to Customs and Border Protection stopping infringing imports from entering the U.S. market.
Steven Zhu, president of Trina Solar US, emphasized the importance of protecting the company’s innovations, saying, “We are committed to defending our innovations and will take decisive action against any infringement on our intellectual property.”
Trina’s complaint focuses on U.S. Patent Nos. 9,722,104 and 10,230,009. These patents cover critical aspects of their TOPCon solar cell technology. Trina first took legal action against Runergy earlier in the year for similar infringements, and now, the company is asking the ITC to block the import of all products using this technology into the United States.
Trina has been investing heavily in its U.S. manufacturing infrastructure, particularly in its new assembly plant in Texas, which is designed to work exclusively with their patented TOPCon cells. However, the company argues that Runergy’s operations in Alabama and China, and Adani’s in India, are unfairly leveraging Trina’s technology, thereby disadvantaging Trina in the U.S. market.
Zhu highlighted that Trina’s intellectual property and compliant supply chain are integral to the success of U.S. solar manufacturing. He also noted the importance of collaborating with U.S. partners who respect intellectual property rights.
